Linen World and the Consultant Agree:

  1. That the Consultant is working as a self-employed, independent contractor who will not be treated as an employee of Linen World for Federal Income, or any State Tax Purposes, and will pay and Self-Employment, Social Security and estimated Income Taxes, and will hold Linen World harmless from any such claims.  At the end of each year you will receive IRS Form 1099 that reports your earnings, rewards and other taxable incentives as a Linen World Consultant.  You are responsible for the payment and filing of all applicable federal, state and local income, unemployment, social security and other taxes, fees or licenses attributable to your business.

  2. That the Consultant will be responsible for any injuries or damages of any kind, which result from the operation of his/her business, will carry liability and automobile insurance and will hold Linen World harmless from any such claims.

  3. That the Consultant is a self-employed, independent contractor, running his/her own business, and is free to carry on business as a direct salesperson in a manner of his/her choosing.  The Consultant may buy and sell Linen World products at will and in his/her individual name.  Linen World Party Plan is offered as one suggested method of selling, and others may have been and can be used.

  4. Within 45 days from the date the Decorator Showcase is issued, you may return the kit in new and unused condition with all original packaging along with catalogs, paper supplies, manuals and totes to Linen World, 19 Cobham Drive, Orchard Park, New York 14127.  If the showcase is not earned or returned, your signature authorizes Linen World to charge your charge account $149.00 for showcase payment.  Shipping and handling is non-refundable.

  5. Commission is based on guest sales.  Sales do not include tax, shipping and handling, guest bonus buys, hostess discounts, hostess credit and bonus buys.

  6. Linen World Award Points are rewarded based on a show count.  For every show with sales of $250 and above, (20) Linen World Award Points will be awarded.  Show with sales of $100 to $249.99 will earn (10) Linen World Points.  (Show sales are determined by guest sales and hostess 10% free merchandise)  Points are earned on a yearly contest basis starting with shows paid August 1st through the following July 31st.  Points can be redeemed and earned towards prizes from our Linen World Award Gift Catalog.  They may also be accumulated and redeemed towards one of the larger incentives.  All Linen World Award Points earned during the contest running August 1st through July 31st must be redeemed by December 31st immediately following the end of the contest year.  Each consultant will notify Linen World of his/her intention with regard to the trip incentive by August 31st (of the year earned).  Dates and location of each trip will be announced by August 1st.  Once Linen World receives your redemption of your points towards any trip or prize incentive, it is final.  Points earned will not be carried over into the following incentive year.
